I purchased a timeshare with Raintree Vacation Club at the Miner's Club in Park City. During the presentation, they told me this could be sold back to Raintree, rented out, using this was very easy and inventory would readily available across various properties. We told them no several times during the presentation but they continued to "lower" the price a couple of times. Reluctantly, we agreed to buy a "gold week". Since we have owned the timeshare, it has become increasingly difficult to use. There is limited availability and when there is availability, the amount of points required is very high. When we initially bought, we received a gold week and success for the first few years using properties in Mexico and Hawaii. At some point, they changed the system to a points based system and it became more difficult to book and use the timeshare. This timeshare is one of the worst decisions I have made. I feel very misled and taken advantage of, especially when the program was switched around on us (week system to a point system, on site parking changes). I have reached out to get this squared away and have received no help from Raintree. Their responses are to sell this through a third party, transfer it to a friend, or book further in advance. The investment we were told this was going to be has changed so much over the years and we just want out of this. I owe nothing to Raintree and have paid all my dues, even when I was not using their system. Resolution Sought I want Raintree to cancel my timeshare ownership. I have met all my obligations, why will they not just take this back and refund me for the maintenance fees that were wasted?

To Whom It May Concern, This letter is a response to Mr. Stehno’s complaints regarding the purchase of their Raintree Vacation Club (RVC) and their request to cancel their RVC Membership. Please allow me to take this opportunity to address the Member’s Concerns: Availability: the time that Members make their reservations in advance can make a great impact in the availability of some resorts and rooms. Many of our Members make reservations with 9-12 months in advance, up to two years with RCI, and therefore some resorts get booked quickly. We highly encourage all Members to make reservations with the most time possible, to guarantee availability in the desired location. Maintenance Fee Increase: the maintenance fee may be increased year by year in a percentage that shall not exceed the combined effects of annual inflation, and the variance suffered in the exchange rate between the Mexican peso and the US dollar according to the exchange rate, plus a 10 over the prior year's maintenance fee. This information is included in the contract and Raintree's Rules and Regulations that were given to the Member at the time of purchase. We have previously informed the Member that all Membership Agreements (“Agreements”) entered into with RVC are non-cancelable contracts after the expiration of a five-day rescission period once the Membership purchase has been completed. As such, RVC is not in a position to terminate any of its Member’s rights and obligations under such Agreements once the expiration of the rescission period has expired and generally will not agree do so. As an alternative approach, we suggested that they may think about transferring their membership interests to a third-party as follows*: 1. Sell their membership interests to a third-party; 2. Assign or transfer their membership interests to a third-party; 3. Donate their membership interests to a non-profit organization. *In each case above, a fee will be payable to RVC to transfer the membership on its membership records. Any of the above options would likely relieve the Member from any and all obligations under their respective purchase documents. Raintree Vacation Club has a very active transfer of rights department processing transfers daily, which is why the options of selling, transferring, or donating are given. Raintree does not have a buyback program and does not assist in the resale of the Membership, that is something that the Members must do on their own. Some Members transfer the Membership to family members, friends, or co-workers. Others go through a resale company. If the Member does decide to hire a resale company, they must be sure to check references before giving them any money upfront since many of them are scams. We have known that some Members have transferred their Memberships through www.ebay.com and www.redweek.com. We bought a timeshare in 2001 at Westin Regina in Cabo san Lucas. The timeshare rep told us that the timeshare has a life of 25 years we were never told that the timeshare is a lifelong commitment. Also, we were promised that since it is a platinum level we will get priority reservations. We used the timeshare a few times but we could not use it most of the time as the resort locations are very far away we often could not get the reservations. Once we were in Hawaii we had to share the unit with our grown-up daughters and they would not provide us a separate bedroom despite having the "platinum" level. The maintenance fee has increased from $600 in 2001 to $1,600 at present after paying $24,000 for the timeshare. The maintenance fee adds up to a significant amount. We do not want the obligation to pay the maintenance fee for the rest of our lives, We have better vacation alternatives closer to home and we have already paid a lot of money towards this scam. We are most upset that we were lied to at the time of purchase that this timeshare had a life of 25 years! If we had known that it is a lifelong issue, we would have never bought the timeshare. Resolution Sought We want a full refund of our money and we want our contract to be cancelled.

This date is listed on the second page of their contract, nowhere in the contract does it state that the membership is 25 years.
