By threat of delay of a project, Gustavo Ochoa coerced us into signing a change order where the scope of some plumbing work was reduced and refused to negotiate or disclose his real costs. The contract includes the language "If the Customer and Contractor cannot agree to a change in the Contract Price, the Customer shall pay the Contractor its actual cost plus reasonable overhead and profit" yet Mr. Ochoa made clear that without the change order being signed, he would not proceed to complete the plumbing portion of the task. ("There's a change order do to removal of a sink I re assess what the cost will be it is your right to accept or decline for the change. I spoke to my legal team and several contractors and that's how it works.", "Correct so I can't start work till you agree or sign if you don't then I can't continue.", "I give you price your right to agree or not..like I said if you don't agree then you can do it your self "). Note, this is about a reduction in the amount of work, so he was at no risk of loss. After repeated requests from us, he refuses to disclose his costs or his overhead or to discuss any pricing but his fixed figure. We proposed what we thought would be a reasonable amount (as we estimated the scope of the reduction in work), but Mr Ochoa refused to address this. This is the second instance of this from Mr Ochoa as he used exactly the same tactic to get a change order for electrical work where it appears that he double dipped for some other work. Resolution Sought We would like Mr Ochoa (as Reform Renovations) to live up to the letter of the contract with regards to change orders and either negotiate in good faith or live up to the terms of his contract and accept the terms "If the Customer and Contractor cannot agree to a change in the Contract Price, the Customer shall pay the Contractor its actual cost plus reasonable overhead and profit" . Yes, I know I should not have signed the change order now, but it seems a consumer complaint is still proper.
