This letter is in response to the complaint submitted by Mr. Lewis, BCA Case. Please be advised, TriStar
Indemnity, LLC dba Repair Ventures Insurance Solutions ("Olive") sells mechanical breakdown insurance to California
consumers for their automobiles. Olive is not the coverage administrator of the policy and does not therefore review,
grant, or deny claims, or have any role with respect to the payment of claims.
Our records indicate that Mr. Lewis purchased a mechanical breakdown insurance policy ("Policy") from Olive on May
20, 2024 for his 2013 Ford Mustang. At the time of purchase, a down payment of $77.58 was collected from Mr. Lewis.
Enclosed are copies of Mr. Lewis' Declaration Page, Mechanical Breakdown Insurance Policy Terms & Conditions
("T&C"), and the Olive Payment Plan Agreement for the Policy.
It is our understanding from the coverage administrator QBE Administration Services, Inc. ("QBE"), the company that has
the contractual obligation to adjudicate and pay valid claims under the terms of the Policy, that they received a call
regarding a claim under the Policy on May 4, 2024. Due to a technical error in their system, they were unable to
generate a claim at that time, of which Mr. Lewis was informed. Per QBE, the error was corrected at the end of business
day on May 9, 2024, and a claim was filed under the Policy on May 10, 2024.
It is also our understanding from QBE that Mr. Lewis' repair facility indicated that his vehicle's right front window was
sticking halfway down, the check engine light was on, and the fuel gage was erratic. Per QBE, the repair facility initially
reported that the cause of the failure was rodents chewing through the wire harness. The repair facility then clarified
that that the window switch was on a different circuit and not a result of rodent damage. QBE has indicated that the
claim for the repair for the window was approved on May 11, 2024 in the amount of $24.99.
Per QBE, the rodent damage to Mr. Lewis' vehicle was not a mechanical breakdown covered under the terms of the
Policy because it was not the result of "defects in materials or workmanship or caused by wear and tear covered by this
Policy" but rather the result of an external force (See Mr. Lewis' T&C, Definitions, sec. 9, pg. 2; Exclusions, sec. 6, pg. 7).
As a result, QBE denied the claim for repairs resulting from rodent damage.
