Roofer failed to see skylites needed to be replaced. after i showed roofer they could not be flashed they said they would get prices. I told them i would not do roof without skylite prices. They called week later with prices and told me to think on it over wknd. I called mon day saying i couldn't except new pid. they went ahead and cashed my 3500 down payment and said they were charging me 500 for cancelling, week later still haven't mailed remainder with no explanation. Resolution Sought Admit they changed the contract by adding skylites to price and return all money paid to them. thanks

Company states; I am in receipt of the complaint. We gave a bid to homeowner to replace his roof. He signed a contract with us and made a down payment. Customer had skylights that absolutely could be re-flashed. Another company allegedly told him the skylights could not be re-flashed but needed to be replaced. I can only assume the other company wanted to upsell skylights. We offered to match the price on skylights. In WI to amend the contract it has to be in writing in the form of a change order or other document. Until such an agreement is entered into, the original contract is the agreement. Nevertheless, homeowner told us he was cancelling the written contract. This was without cause and TWO weeks after the contract was signed (customer had also been given documents explaining how he could cancel the contract within 72 hours and even given documents to do so, without any penalty to him). In WI for such a breach of contract we would be entitled to all lost profit. As I licensed attorney in WI, I can state this is the case. However, rather than keeping the funds to cover lost profit, we returned the money, less $500 to cover the significant time spent on the project. In hindsight, maybe we should have retained all we were entitled to under WI law, which would have been significantly higher than the $500. Bottom line is customer falsely believed he needed new skylights. Even though he didn't and we offered to install new skylights for additional cost, agreeing to match the price he was given for skylights by the other company. We absolutely would not have said we could re-flash the skylights if we couldn't do it. Otherwise we would be out there after every rain storm fixing leaks. No one wants that, especially us. Maybe the homeowner should consider the fact the other company didn't know what they were talking about and just maybe they were trying to upsell him into something he didn't need. At the end of the day, the customer was in breach of the contract. No one forced him to sign a contract. But once he did, legal obligations arose. He entered into an agreement and broke that agreement without cause. We withheld much less than we could have under the contract and WI law. Had the customer not canceled the contract he would have ended up with a very high quality roof. Our business is based on being upfront with customers. Yes we could have made more money had we falsely told the customer he needed new skylights rather than re-flashing them. We don't operate that way. However, if the customer still wanted new skylights, we could have done a change order in writing as required by WI law and installed skylights. He didn't want that and instead breached his contract. In any event, please consider this our response to his complaint. We will not be refunding any additional sums and if pressed will go after all we are entitled to under WI law.
