This attn handling my dad's estate is making decisions to donate some of my father's property and will not send me receipts or copies of anything that has been paid or anything that is owed. I am sole beneficiary and it seems like this attny is trying to spend or donate my dad's estate despite contacting me to see if maybe I would want to keep some of his stuff I have made repeated attempts to contact this attorney I have even off weed to pay whatever is owed in my dad's estate if I could get copies of what's owed and what's been paid but despite my attempts this attny will not contact me I am not executor of this estate my aunt is and we are at odds and have been for some time my father was going to change his executor to me and unfortunately passed before being able to do so now the executive of his estate along with this attny are trying to get rid of all my dad's belonging and bank accounts.. he had a TOD to house for me it took them almost 5 mis to contact me and give me keys to property and by time I got in the house everything that was anything had been removed by the executor .. and with a tod the lawyer should have contacted me asap because the house was not part of the estate so she had no right to take anything out of that house and I had to contact the attorney to get this done and he was very rude and disorganized it took him almost 45 min to find my dad's case among all the files string all over his office Resolution Sought I want receipts of what's owed and what's been paid as well as having him NOT donate my father's vehicles or anything else without consulting me first

Mr. D. A. Armstrong passed away on September 9, 2020. My first appointment with the Executor was on September 17, 2020. In order to commence the Estate, it is necessary to obtain a copy of the death certificate as well as notifying all the persons who could inherit if there were no Will as well as all the people named in the Will. It is also necessary to notify the Ohio Attorney General when the decedent is over the age of 55. The Will was filed with the Court on October 21, 2020 and the application to provate the Will, with proof of notification to potential heirs was filed on November 20, 2020. Miss Armstrong had an appointment in my office on November 9, 2020 and the process of the Estate was discussed at that time. Miss Armstrong alleges that the real estate (subject to a Transfer on Death Affidavit) was not transferred for 5 months. Miss Armstrong was notified of the Transfer Affidavit and that we were awaiting the death certificate to proceed. The truth of the matter is that the Affidavit transferring the real estate was recorded on October 29, 2020 and she was provided a copy of that on November 9, 2020. I have no knowledge of when she received keys as that was not part of the Estate and those were delivered to her by her aunt. As might be expected, Covid 19 did have an effect on all these matters. The procedures with Probate Court, County Auditor and County Recorder were all modified due to the pandemic. It has been necessary to search and determine what all assets were Probate assets to be administered. We have been informed that a Life Insurance company has indicated that they cannot find any information or status of the policy upon which we had information. I am still attempting to obtain information of employee benefits due to Mr. Armstrong from Automotive Distributive Warehouse. In other words, we are still searching for assets. A copy of the Inventory filed with the Probate Court was sent to Miss Armstrong on June 2, 2021. It reflected all the assets that we are aware of at this point. As mentioned, we are still seeking additional assets and, if they are located, we will file an amended Inventory. I am enclosing a copy of the Inventory filed with the Court (provided to BCA for review). I have had several telephone conversations with Miss Armstrong all ending with her not listening and being loud and abusive. Recently her Telephone calls (several) have been in the very early hours. (1:00 to 2:00 A.M.) Ms. Armstrong is NOT my client. I represent the Estate and the Executor and we are trying to administer the Estate in a proper and expeditious manner. I fully realize that there have been some delays but those delays are occasioned by the circumstances of the pandemic and/or the difficulty in location additional asset. We will be filing accounts and information relating to the administration of the Estate and Miss Armstrong will be furnished with that information (which is all public and on line). Miss Armstrong is free to schedule an appointment with me at any time provided that she can conduct herself in an appropriate manner.
