An individual signed a contract with this third party electric company for MY electric account back in May 2022 .This company accepted his signature in place of mine and forced this 36 month contract on me even though I personally never signed or accepted these terms. The contract was cancelled when I confronted the company, but they refused to refund me the charges and insisted I had to pay the following three months of their service before the service was officially cancelled. This is a textbook case of fraud and theft. The company refused to allow me to speak to a representative and I found it difficult to even get my calls answered. Resolution Sought I want a COMPLETE refunding of ALL electric charges I've incured that have included charges through this company since the signing of and implementation of this fradulent contract as well as a written statement that no further charges will be accrued any further.

To Whom it May Concern, Thank you for forwarding this complaint. We have reviewed the account and found the following. The enrollment in question was completed on April 25th, 2022, and the person representing himself as having authority to enroll the account was Mr. Diorio. He identified himself as the roommate of Mr. Kususky and voluntarily completed the enrollment. The account information was provided and verified by Mr. Diorio during the electronic verification process. A short confirmation telephone call was also made with a third-party verifier to confirm the action being taken. The following day a welcome packet with terms and conditions was mailed to the address provided in this complaint. No returned mail has been received for this account. Neither Mr. Kususky or Mr. Diorio requested the account be cancelled soon after enrollment. On August 9, 2022, Mr. Kususky called and spoke with Rushmore Energy representatives two times. He stated that Matt Diorio was his roommate but did not have authority to make changes to the account. He requested Rushmore cancel the account and email him the signed documents. Rushmore representatives sent a drop transaction to the utility and waived the early cancellation fee as a courtesy. The signed contract was emailed to the customer the same day. The next day the utility confirmed the drop transaction and set the service end date to September 16, 2022. On September 21, 2022, the utility updated the service end date to September 20, 2022. Rushmore Energy processed the cancellation immediately upon notification by the customer, and no early cancellation fee will be assessed. We have spoken to both Mr. Kususky and Mr. Diorio on multiple occasions and explained that the service end date is set by the utility. From the time the customer reached out to Rushmore in August there have been two billing cycles. The final billing cycle ended on September 20,2022. No further supplier charges from Rushmore will appear on the bill after the period ending September 20, 2022. We have attempted to contact Mr. Kususky to resolve the issue and will continue to do so. I was solicit by an employee of Rushmore energy in front of Aldi on East 95th st Chicago, IL. To receive a gift card from comed and a tablet if I signed up with them. The employee stated that Rushmore was contracted by Comed for reduction in bill, also receive tablet. At the end of the process of signing I was required to pay $20 for the service. My complaint is I gave personal information and it could be used for fraudulent purpose. Resolution Sought This company be investigated and shut down for misrepresentation and possible fraudulent use of confidential information.

To Whom it May Concern: Thank you for forwarding this complaint. We have reviewed the enrollment for Mr. Stuckey's account and found the following. Mr. Stuckey was sold a 36 month fixed-rate contract by in-person solicitation on August 23, 2022. At the time, he electronically reviewed and verified the account information, and also verbally confirmed the account for Theresa Stuckey on a telephone call with a third party verifier. The number used for the enrollment matches the number submitted with this complaint. The enrollment was processed and sent to the utility on August 25, 2022. However, because the account was flagged by the utility as possibly receiving government assistance, the enrollment was rejected. No changes will be made to the Stuckey account, and it will not switch to Rushmore Energy for electricity supply. The actions of the sales agent described by Mr. Stuckey go against Rushmore Energy policy and training, and the vendor and sales agent involved are being investigated. Appropriate disciplinary action will be taken. There is no further action required on Mr. Stuckey's part. No changes are being made to the ComEd account by Rushmore Energy.
