He isn't taking responsibility for breaking my backsplash above the new sink-side cabinet that he built. He charged me $347.38 for removing my backsplash that he broke. He told me that he was going to lie to my homeowner's insurance company saying it broke on accident to cover up his mistake so that it can get paid for by my insurance. In actuality, he purposefully took it off my wall and broke it in half. This new cabinet was incorrectly built higher than my existing cabinet, on the opposite of my kitchen. Since the broken backsplash is the same material as the countertops, it will cost me almost $9900 to replace all backsplashes and countertops! He refuses to file a claim with his liability insurance probably because he doesn't want his premium to go up, at the expense of my wallet! He refused to return my kitchen cabinet doors and drawer faces, holding them ransom for many months, he threatened to file a mechanics lien against my condo, file a law civil suit against me, and cancel my building permit unless I pay him more money on his change orders that I never signed nor pricing that I never agreed to. His practices are EXTREMELY unethical. Resolution Sought Pay me $9900 for the replacement of my kitchen countertops and backsplash that he damaged. Stop threatening to sue me especially since I never signed nor agreed to the price on his change orders and especially since he said that I would not have to pay more than my home insurance deductible for a water damage claim.

Megan, you were well aware that your repairs were under estimated by your insurance company. I made no promises, but told you that I would do the best I could to convince your insurance adjuster that he had underestimated your damages. Your claim was then raised from $5,576.00 to $24,223.67 by my efforts. Then your attorney wanted me to complete your work for $15,000.00. That is what caused your work to stop. Six weeks after “Carpet Market One” installed your vinyl floor, my carpenter (at the starting his work) spotted and brought to your attention two light scratches in your floor (likely from sliding boxes across your floor). My carpenter informed you so as not to be blamed for the scratch damage. That damage was caused during the six weeks we were off the job per your COVID request (not our fault). You had me do extra work by lowering a base cabinet we previously installed. At the new cabinet location, your back splash now no longer fit, and now needed to be replaced. It broke during the demo process. It really did not matter because the back splash now required replacement anyway (not our fault). As far as the height of your cabinets go, ServPro provided photos that prove that the cabinet I built was correct. Your account of my performance is full of UN-truths and inaccuracies! You did not pay anything for the stained cabinet doors. I released them 30 days after realizing that I would likely never be paid for them. At no time did I threaten or file a Mechanic’s Lien, even when I should have. I thought I would give you “the benefit of the doubt.” Clearly I was wrong!

I made a complaint to the California Department of Insurance and State Farm STILL did not pay more than $24,223.67. Lowering the sink-side base cabinet was NOT extra work because it was previously built to the same height as the stove-side base cabinet before the water damage occurred. You built the sink-side cabinet too high so it is part of YOUR job to correct this mistake and lower it WITHOUT charging me extra for it. I should NOT be the ONE to pay for YOUR mistake. My backsplash no longer fit because YOU built the sink-side cabinet TOO high. I should NOT be the ONE to pay for YOUR mistake. If my backsplash broke during the demo process then it is YOUR responsibility to make a claim to YOUR liability insurance because YOU broke it. My insurance company or I should NOT be responsible for paying for something YOU broke. That is the reason why YOU have liability insurance. I saw the photos that you claimed ServPro provided you and it does not substantiate ANYTHING you are claiming. You owe me $9900 for damaging my backsplash so I do not owe you for these stained cabinets. On 3/11/21 you threatened me saying, “I file a Mechanics Lien against your Condo.” Karma will catch up to you.
