Attempts to contact Mr. Hearn concerning his unpaid rent in January went unanswered. Without a response, and per Ohio law, Mr. Hearn was given a 3-day notice on January 6, 2023, and only when we attempted to put an abandonment notice on his door after the 3-day notice was expired, did we hear from him. Mr.Hearn stated that he was moving from the property, and asked to havea few days to get everything out and cleaned. I told him to submit his 30-day notice in writing as required by his lease terms, (he did so via text message. Tenants are always responsible to pay rent up until the end of the 30 days. I asked fo a forwarding address, to which he stated that he didn't know it. I told him to call us with it when he knew it. We received the keys to the house the morning of January 18th. Mr. Hearn called me again on Jan. 20th after sending a text asking if I had received the keys, ( I had not had a chance to respond to his text before he called.) He asked how long it would take to get his security deposit back. I stated that I needed a forwarding address for the sec. deposit letter and that I wasn't sure he was going to get anything back because almost the entire house had to be painted due to the sharpie graffiti on the walls. He stated that he still didn't know the address of where to send it. Mr. Hearn called the evening of February 16th. The first thing I said to him when I picked up the line was, "Did you get me that forwarding address?" He asked if he could stop by and pick up his security deposit instead, to which I answered that we always mail security deposit letters. If he would give me an address, I could mail it out immediately. He said that he would call me back with an address, and 15 minutes later he did so. Mr. Hearn owes rent unti lthe end of his 30-day notice as stated on his lease on pages 15-16, Section 7. He also owes late fees for January until his move-out date of January 18th. The home had 17hours of maintenance labor hours billed @$50.hour to paint the house, change blinds, replace light bulbs, toilet paper holder, replace a towel bar, and peel decorative stickers from the shower and walls. Mr. Hearn currently owes us $1,743.70.
