The tattoo artist and I have done two viable exchanges of business together and never once has she complained about my discussions with her. Now she is accusing me of using a racial slur in conversation with her which is a completely false accusation. I spoke about my health issues, my line of work, and family dynamics as well as artwork in general. The accusations are completely made up and I never used a racial slur and I am owed the touch up services which are part of the agreed upon contract I signed. If she wishes to not complete the touch up it is only fair that she refund me the amount a touch up would cost which is around 1 hour of work. Resolution Sought I would like a partial refund of the services not provided which included a touch up of my tattoo. The tattoo artist refuses to provide me the touch up which is always included in the cost.

Company Response

Lacey, you did in fact use a racial slur in my studio during our last session. The context of the conversation was that you were telling me about your new job as a teacher. When I asked you how you were enjoying it you said, “it’s okay, I work at one of the more poorer schools. A lot of my students are black so they can be kind of rowdy, and I can’t stand how they go around calling each other [N word] all of the time.” Despite your extremely inappropriate comment, I finished your tattoo in it’s entirety and we completely our transaction. When you reached out to me to schedule another session, I politely declined to tattoo you again. My response to you was professional and kind. You then continued to harass me for said message, including threats to sue me. As regards to the touchup service, there was never a contract that we signed ever, not once. And definitely not one that ever said your tattoo included a free touchup. Also, touchups are not “around one hour of work”, that is an entirely false claim. Touchups can take as little as a couple of minutes, it varies greatly from one tattoo to the other. It is my right as a business owner to deny service to anyone. There is no reason to provide any sort of refund, as I’ve completed the service we agreed upon already.

I will be filing a small claims action suit against the respondent if there is no action taken within the week. We agreed to a completed transaction and as to date, the tattoo work it is not completed. Full stop.

Company Final Response

The tattoo was completed, in its entirety. There is quite literally photo evidence of it. Please by all means, go ahead and file your claim. I cannot say it more clearly to you, that, I don’t even know what you think you deserve compensation for. It’s very simple Lacey, you paid for a service, and that service was provided to you. A touchup session is not part of that service. As a business owner, I am using my right to deny you service, that doesn’t just mean you deserve money for that. End of story. I will no longer be responding to your nonsense.
