I have been paying this company auto pay out of my account since I started my loan have not missed a payment. I car engine and transmission was very unsafe for travel. Also my payments were not being updated to all credit bureaus until last month which the balance is inaccurate stating I have already covered 7100.00 in payments to a 10,694.00 balance on my credit it shows I owe another 6100.00 which this loan was an upside down loan. Resolution Sought I will like to sue and clear my name and credit with this company and want a refund on the damage car I was sold

Company Response

In reviewing Mr. Barrett's complaint, it encompasses two separate businesses. To clarify, Superior Car Credit (SCC) in DeKalb Illinois sold Mr. Barrett a vehicle. Mr. Barrett signed a Retail Installment Contract and Security Agreement and obtained financing, for his vehicle, through Drive Now Acceptance LLC (DNAC). Responses below are from each company accordingly. This complaint came in against Superior Car Credit located in Freeport, IL, which is confusing as Mr. Barrett did not purchase a vehicle at that location. I have confirmed with the General Manager and the Service Manager in Freeport, there has been no contact with Mr. Barrett or has his vehicle ever been in their service department. I then contacted the General Manager and Service Manager for Superior Car Credit in Dekalb, both have confirmed that they have had no contact with Mr. Barrett nor do they show any record of the vehicle being brought in for service work. Mr. Barrett claims that the engine and transmission had issues. Mr. Barrett has now been driving this vehicle for over 20 months and we have no documented issues. Additionally, Mr. Barrett purchased a Service Agreement for 20 months or 20,000 miles, which would have covered those issues. DNAC reports to the Trans Union credit reporting agency. We have reported monthly all payments on time. We report once per month. Any payments made resulting in balance reduction, between updates, will not reflect until the following month. We are neither required nor obligated to report to multiple credit reporting agencies. Mr. Barrett is not factoring in any of the finance charges into his payment calculations. Finance charges do not decrease principle balance owed.
