Please allow this letter to service my law firm's formal response to your letter which we received on Tuesday, February 11, 2025. As detailed below, Mr. Filipowicz retained Nicholas J. Theos, Esq. and the Theo's Law Firm on or about October 23, 2023, to provide legal representation pertaining to (5) pending criminal cases and (1) civil restraining order case. These cases were pending in the Beaufort County Criminal Court of General Sessions, the Blufftom County Magistrate Criminal Court and the Bluffton County Magistrate Civil Court. Subsequently, Mr. Filipowicz with was charged with additional criminal offenses, nine (9) sex offender registry violations for which we also provided legal services without requiring additional fee. Per our written and signed engagement agreement a flat fee of $40,000 was required to be paid as follows $15,000.00 due immediately $5,000.00 due on or before November 23, 2023; and, $20,000 due on or before March 1, 2024. Mr. Filipowicz failed to comply with the above agreed upon payment schedule. Nonetheless, our law firm provided legal services to Mr. Filipowicz pertaining to all of his pending legal matters from October 23, 2023 through February 4, 2025. During that time, several hearings were held well in excess of 125 hours were expected in providing representation. All of the above referenced cases have been resolved and/final dispositions have been entered. The only pending matter which awaits Mr. Filipowicz is a sentencing in the Beaufort County court of General Sessions to which Mr. Filippowicz has previously plead guilty. Notably, Mr. Filipowicz's sentencing hearing in this matter was set for Tuesday, February 4, 2025, before the honorable judge Carmen T. Mullen, before the General Session Chief Administrative Judge for the Fourteenth Judicial Circuit. Attorney Nicholas Theos was present and prepared to go forward to advocate for Mr. Fillipowicz behalf at that time. However, due to threats of violence and physical harm that Mr. Filipowic'z directed towards Nicholas Theos and the Theos Law Firm prior to his sentencing hearing, our law firm was relieved an counsel by the court. Moreover, as a result of Mr. Filipowicz threats, we were required to hire private security to monitor Mr. Filipowicz whereabouts. Additionally, the city of Charleston Police Department provided onsite surveillance at her office building due to the multitude of threats by Mr. Filipowicz. Further, on February 4, 2025 at the above reference hearing an order of no contact and restraining was issued against Mr. Filipowicz by judge Mullen prohibited him from having any contact with Theo's Law Firm and its lawyers. Per your letter, Mr. Filipowicz has claimed "I gave Theo's Law Firm $45,000 to render legal services they did not render" and "[he] would like [his] $45,000 back". That accusation is misleading and untrue. In fact, Mr. Filipowicz has an outstanding balance due and owing to our law firm in the amount of $7,621.80 for unpaid fees and reimbursable expenses. Again, as stated above, we also undertook and provided representation related to subsequent charges for which we did not require additional fees. Per his sign engagement agreement, a retainer fee of $40,000 was required, of which he paid only $35,000. Our law firm provided and rendered all agreed upon legal services and accomplished extremely favorable results on Mr. Filipowicz behalf. Mr. Filipowicz complaint is faceless and blatantly false, as he is not entitled to any refund.
