Upscale Auction House complaints

Complaint Details: I am the owner of MHS Cutlery, a business that consigns knives to auction houses and private auctioneers. In January 2025, I shipped multiple boxes of knives to Jimmy Sommerfeld for auction consignment. Delivery was confirmed via USPS tracking, and Mr. Sommerfeld acknowledged receipt by email. We agreed that: Items would be sold at auction. He would retain a 20 commission. Proceeds would be remitted to me as sales occurred Any unsold items would be returned. Mr. Sommerfeld sold part of the inventory and sent one partial payment of approximately $740. However, he failed to provide a complete accounting, failed to remit the remaining proceeds, and failed to return unsold items. In July 2025, his wife, Teresa Sommerfeld, explicitly agreed in writing to settle the remaining balance for $900, stating that a check would be sent by July 20, 2025. Despite this written agreement, no payment was ever sent. Since then: Repeated emails and follow-ups have gone unanswered. No payment has been received. No knives have been returned. No tracking or proof of shipment has been provided. As of today, Mr. Sommerfeld still possesses my property and/or its proceeds, valued at $900, with no communication or resolution. Resolution Requested: I respectfully request assistance in compelling the respondent to: Pay the outstanding $900 immediately, OR Return all remaining unsold knives immediately.
