My wife and I are writing to your offices today for assistance in resolving a dispute we have with a timeshare known as Vacation Village at Parkway in Kissimmee, Florida. We have been trying to communicate with this company and they will not address any of our concerns. We now need your involvement to bring this matter to an end. This company has wronged us in so many ways and they need to make this right. In 2014, our desire to use this timeshare came to an immediate end when the young kids in my family traveling group were groped at the resort's large pool and patio area. During 2014 we brought this to their attention and now years later still have to pay for a timeshare we are not using. During the last year we have tried to resolve this matter again by calling and mailing them letters. They consistently dismiss our claims and continue to charge us more money for maintenance fees. After review of this complaint and my response, I believe there is a miscommunication. The owner never filed a complaint with the resort regarding their very serious allegations. A police report should have been filed by the owners to which I cannot attest since I have no record of a complaint. As long as they continue to be owners the maintenance fees will continue to be due on an annual basis.

In the summer of 1998, we were given a free 4-day cruise with the agreement to attend a sales meeting. The meeting lasted at least 3-4 hours, with a salesperson and then 2 managers, one after the other, being called in to pressure us into a decision to buy. We felt profoundly uncomfortable with the immense pressure, and we eventually caved in. We purchased a week at Vacation Village at Bonaventure. Since our purchase, we have not been able to reserve at places where we really wanted. The locations we did visit were dilapidated. We had to be moved to different rooms twice because of broken air conditioning pipes. We were once assigned to a damp room in the basement that had one small window and smelled of mildew. We spent two nights there and we had to complain repeatedly before we were moved to a clean suitable room. On another occasion, we arrived at a place where the pool was under reconstruction, but we were never informed of this before we arrived. This timeshare has been a headache and a financial burden in our retirement years and could use the money for more important issues as we age. Have health issues that limit our use of the timeshare and therefore have lost interest in using it. Our children are not interested in buying it from us or in inheriting this timeshare so there is no use in subjecting ourselves to any more misery. We want OUT! Resolution Sought We stated our desired outcome above. We don't want to be affiliated with this company anymore and we want our money back.

The company advise that they are a timeshare homeowners association that does not sell timeshares, and it does not resell them. The association does not collect mortgage payments. It only bills for maintenance fees and taxes relating to the maintenance of the property. Their association cannot refund the purchase price as they did not receive those funds. That claim must be made against the developer and not the association. They further advise that your complaint should be directed to the developer of the property for which you should have signed paperwork. Any owner which is claiming a financial or medical hardship should contact the Owners Resolution Department at 954-384-9445. Ex. 13209.
