W6LS, Inc. dba WithU ("WithU") is in receipt of your letter dated June 09, 2022, concerning a complaint submitted to you by the complainant. WithU is an entity wholly owned and operated by the Otoe-Missouria Tribe of Indians, a federally recognized sovereign nation located and operating with the United States ("Tribe"). Your correspondence concerns an online loan the complainant applied for and received on May 26, 2022, in the amount of $1,000.00.
WithU is appropriately regulated pursuant to the laws of the Tribe and, accordingly, maintains its own regulated process for the purpose of addressing consumer complaints. The Tribe's regulatory entity, the Otoe-Missouria Consumer Finance Services Regulatory Commission ("Commission") is authorized, pursuant to Tribal law, to exercise jurisdiction over the Tribe's consumer finance service activities, which include proper oversight and enforcement of the Tribe's laws. This includes the Tribe's Consumer Finance Service Regulatory Ordinance ("Ordinance") as well as applicable federal consumer protection laws, such as the Equal Credit Opportunity Act, Fair Credit Reporting Act, and Truth in Lending Act.
As an entity operating under a license issued by the Commission, WithU Loans is subject to the Commission's enforcement authority, and is therefore duty-bound to conduct business in a responsible manner and in accordance with Tribal law and applicable federal consumer protection laws. To that end, WithU maintains its own mechanism and procedure for the handling of consumer complaints. Consumers may direct their complaints to WithU by email to complaints@withuloans.com. At that point, WithU's representatives will contact the consumer directly to attempt to resolve the matter on an amicable basis.
The Loan Agreement that the complainant electronically signed provides that she agreed to make fifty-one (51) weekly payments in the equal amount of $103.33, together with a final payment in the amount of $101.73 on May 26, 2023, unless the complainant elects to pay the loan off sooner.
As of the date of this correspondence, the complainant has made two (2) payments. One payment in the amount of $103.33 and the other in the amount of $144.78. Each of these payments has been applied to the outstanding balance in accordance with the terms of the Loan Agreement.
