The company is making unsubstantiated claims concerning the effectiveness of its magnetic products. Many of these claims are made at a free dinner the company offers. At the dinner, the company makes a presentation on the benefits of its magnetic products. According to the Food and Drug Administration (FDA), companies that manufacture or sell devices intended for medical purposes must first obtain marketing clearance for their products from the FDA. To date, the FDA has not cleared any magnetic products for marketing. Any company selling merchandise outside of its permanent place of business must provide consumers with a three day right to cancel if the purchase price is more than $25. According to the Federal Trade Commission's cooling off rule, the right to cancel extends until midnight of the third business day after the sale. The salesperson is required to advise you of your right to cancel at the time of the sale and provide two copies of the cancelation form on a copy of the contract or receipt. The contract should be dated, listing the name and address of the seller.
