Comments and Analysis

This company offers a membership based business opportunity in the sales and merchandising industry promoting home décor products. They offer three different types of membership packages Buyer’s Club Premiere and Enterprise. The Buyer’s Club is free. The Premiere membership is $19.95 per month and the Enterprise membership is $39.95 per month. The fee also provides members access and rights to purchase and sell Smart Living Company products. The membership must be renewed annually at a cost of $49.95 and is automatically renewed and billed to the credit card on file for the account on the 19th day of the anniversary month or the next business day thereafter.~~Buyers that cancel within 90 days of joining may be eligible for a refund of membership fees (excluding shipping and handling). Members are instructed to call 1-800-345-4762 for eligibility and cancellation instructions. Buyers that cancel after 90 days will remain responsible for any remaining fees until paid in full. Upon suspension cancellation or termination of your membership any unused credits or funds remaining in your account remain the property of Smart Living Company. Buyers are solely responsible for all aspects of operating their business including compliance with all applicable federal state and local laws ordinances and regulations and for paying taxes to the State and IRS.~~We routinely recommend that prospective purchasers should insist on reviewing all details of any offer before making a buying decision.

Other Considerations

We’ve recently received reports that a company named Homebased Business Consulting Services or Business Recovery Services LLC located in Arizona and operated by Brian Hessler has contacted customers of SMC EMC and other businesses offering to obtain refunds and provide counseling to obtain a refund charging some $700. We know of no complainant who received preferential treatment or who received any incremental benefit by using that company’s services. The company's principal was previously involved in another similar business targeting victims who had been previously swindled by a vitamin company offering to provide assistance recovering funds for a fee. ~~If you've been a victim of a scam chances are pretty good you're on a "sucker list" and vulnerable to a new scheme called "reloading". Here's how it works. After you've been scammed someone – perhaps posing as a law enforcement officer – shows up at your door and offers to help recover lost money. You are embarrassed that you fell victim in the first place yet relieved that someone is finally offering to help. But there's a catch: You're asked to write a check for this so-called help. Officials warn that the fee should serve as a red flag. ~~According to the Federal Trade Commission ‘reloaders’ – scammers who use the reloading scheme – know that anyone who's been duped once is more likely to fall for a scheme a second time. As a result crooks create sucker lists that include names addresses phone numbers and other personal information of consumers who have already fallen prey to the scams. You can fall victim to a scam whether you've been tricked before or not. But if you are a victim watch for signs of a reloading scams. ~~
