Comments and Analysis

New consumer protection laws in California went into effect on January 1 2007 and has tightened existing towing regulations and added criminal penalties for certain violations. Under the law towing companies are required to obtain written towing authorization from property owners prior to any tow and present it to the vehicle owner prior to obtaining payment keep records for a period of three years for inspection by law enforcement of all towing authorizations and photographs of vehicles illegally parked in front of fire hydrants or blocking entrances. The law also requires towing companies and their drivers to immediately and unconditionally release a vehicle that is still on private property and to make a good faith inquiry of the property owner or agent that the vehicle being towed was unlawfully parked for at least one hour before commencing a tow. Violations of any of these provisions are criminal misdemeanors.
