Complainants allege non delivery of ordered products, and inability to obtain refunds. Customers claim they order, and pay in advance, for items offered on the company's website or catalog. When orders fail to arrive, complainants allegedly receive the run around. In some cases the company informs waiting customers that the item ordered is not in stock, asking for an extension of the delivery date. In other cases, customers are allegedly informed they will be receiving refunds, however, refunds fail to arrive.

Comments and Analysis

This company sells kits and acessories to modify auto body styles. The company purports to be in partnership with Holsen Heavy Industries GMBH and Accolade Ventures USA.

According to the company's terms and conditions of sale, no refunds are issued. Authorization to return any and all products must be obtained by the Buyer from Accolade® in advance and must be made within (2) days of receiving the product. All returned or cancelled products to Accolade® are subject to 25% restocking fee or 25% cancellation fee. Buyer must pay for all Shipping / Handling fees on any and all returns to Accolade®. All products which are approved for return are for store credit only. All products returned for credit must be in the original manufacturers carton in the same condtion as it was originally delivered by Accolade® to the Buyer. Only the original Buyer may request for a return of products. All warranty cards and other such items must be included with the product being returned. Defective items may be exchanged for the same item only, and only after warranty has been cleared from original manufacturer will the Buyer receive product back. After receipt of goods, Accolade® shall inspect the goods to determine the exact quantity and condition of goods received. If Accolade® does not accept the goods as being defective and/or returnable for any reason, buyer must accept incurred costs. Special Orders, Custom Made Orders, and all Electrical or Mechanical parts are not returnable.

The Federal Trade Commission's Mail Order Rule allows the seller 30 days to ship ordered products to the buyer unless otherwise specified at the time of purchase. If the seller cannot ship within the 30 day period, they are required to notify the buyer in writing of the delay, and give the option of waiting, or having their money returned within seven days. Credit card payments must be credited within one billing cycle.

Merchants who violate the Rule can be sued by the FTC for injunctive relief, monetary civil penalties of up to $11,000 per violation (any time during the five years preceding the filing of the complaint), and consumer redress (any time during the three years preceding the filing of the complaint). When the mails are involved, the Postal Service also has authority to take action for problems such as non-delivery. State law enforcement agencies can take action for violating state consumer protection laws
