BCA's Summary and Analysis:

Of the complaints we have received against this company, in at least some cases, the complaint allegations are very serious.

Complainants allege failure to honor requests for cancelling and dissatisfaction with services. One customer claims the company stated not to pay creditors and that they had direct contact with cardholders. Another complainant alleges the company claimed over the phone that they could stop late fees and penalties. However, after the customer received the package, the information stated that not all creditors participate in their program and the company failed to disclose the first payment is collected by their company. Another customer states the company refused to cancel services because the customer failed to cancel within ten days although the customer claims the company did not disclose the cancellation policy.

The company responds to one complaint by stating the security deposit is forfeited if the contract is cancelled within 36 months and they have a recording indicating that the information was disclosed to the customer. The customer requested the information in writing, but has not received it to date.

Comments and Analysis

This company is providing marketing services and referring clients to Credit Foundation of America, a non-profit credit counseling organization with an unsatisfactory rating based on a pattern of erious complaint allegations. A separate report on that company is available upon request.

Any non-profit organization offering credit education, counseling, debt management or debt settlements which collects money to be distributed to creditors, may only charge $50, in advance as payment for offering education or counseling in connection with these services. Also, they may not collect more than 6.5% of the monthly disbursement or $20 whichever is less, as a monthly service fee. Debt settlement fees may never exceed 15% of the amount of debt forgiven and payment may not be collected until the debt is settled. They must also report quarterly to the consumer, the total payments received and total amounts paid to creditors. Any complaint received must be responded to within 5 business days, funds must be disbursed no later than 15 days after receipt, or by a scheduled reimbursement date, whichever is greater.
