BCA's Summary and Analysis:

Most complainants allege the company fails to perform debt negotiation services, which resulted in lawsuits, wage attachments, accruing late fees, or collections. Some customers complain of the lack of communication regarding their accounts, creditors not being contacted, or failure to disclose that negotiations with creditors do not commence until sufficient funds are accumulated to make settlement offers to creditors. A few customers state they did not receive refunds upon cancelling services.

The company responds to complaints by explaining they work diligently to resolve the matter with customers. The company explained that a portion of the retainer is non-refundable, fees are disclosed prior to entering the program, or they can provide evidence of the services performed. The company issued a full refund in one case, and provided a refund in another case where monies were withdrawn in error after cancelling. In some cases, the company failed to address allegations of failing to provide services as represented.

Comments and Analysis

This company offers a three year plan to negotiate and settle debts at 25 to 50% less than what is owed. Promotional literature for this company advises potential customers by enrolling in their program, they can help stop harassing calls from creditors, and help consumers avoid bankruptcy by negotiating with creditors to reduce the debt amount, and defer interest charges, late fees, or other penalties. These types of companies rely on negotiating with the creditors for a lump sum payment, which generally requires the consumer to withhold payments for an extended period of time. Also, fees for these services are generally required to be paid in advance before any debt negotiation services are performed. It is during this time that the creditors will likely take steps to secure payment, such as; telephone calls, derogatory credit reporting, arbitrations or law suits. For the foregoing reasons, we advise caution in dealing with debt negotiation/settlement companies.
