BCA's Summary and Analysis:
Complainants allege high pressure sales tactics and various misrepresentations were used to pursuade them to sign sales contracts. Some customers were allegedly told their utility bills would be decreased by 50% as a result of installing the Everclear system. Other customers complain they were led to believe their water was contaminated, or posed other health risks. Many customers experienced difficulty cancelling contracts, or obtaining a Spanish language contract when in fact they were unable to read English. The company responds to a few complaints by denying the allegations and contend full disclosures about the system and the contract were made at the time of the sales presentation. Many other complaints are unanswered.

As a result of a two year investigation by the CSLB and the Ventura County District Attorney's office, on November 13, 2001, the Glendale Superior Court granted a permanent injunction against the company, it's owner and some of the employees. The order prevents the company from selling, soliciting, advertising, contracting for, or installing water filtration systems in the State of California. During the Court proceedings Everclear conceded their contracts were unlawful because, among other violations, they violated the three day cancellation law, failed to provide spanish language contracts for consumers who were unable to read english contracts, and were found to have made fradulent or false representations to induce consumers to sign contracts. In addition, since the filtration systems were installed as permanent plumbing fixtures, the firm was also found guilty of operating without a Contractor's license. Sentencing for the Corporation and employees is scheduled for February 19, 2002. Victims received notification letters from the State advising them the company had been found guilty of felony and misdemeanor charges, and that four of the finance companies used by Everclear agreed to forgive all future payments on accounts.
