Complaint Resolution Index (CRI) Explained The Complaint Resolution Index (CRI) is an indicator on how responsive a company is in addressing and resolving customer complaints brought to their attention by BCA. If they are considering doing business with the company, consumers can use this indicator to forecast the likelihood of having their issues addressed if a problem arises. CRI measures the company's customer satisfaction abilities through BCA’s complaint mediation process.

Some complainants allege the company fails to obtain loan modifications or otherwise provide foreclosure assistance services. Complainants allege the company misrepresents the effectiveness of their services to get a reduction on interest rates or payments and does not honor their money back guarantee. Some allege they are told by the company they qualify for loan modifications and later are turned down by their lender. Many are dissatisfied that the only offer they receive from the bank is a short sale. Description:

In August 2013, the California Bureau of Real Estate (“BRE”) filed a Desist and Refrain Order against First One Lending Corporation (“First One”), dba First One, National Mortgage Help Center, John Vescera (“Vescera”) and Randa Mahmoud El-Farra (“El-Farra”). Based on the investigation the BRE determined that First One, Vescera, and El-Farra had engaged in acts or practices in violation of California Business and Professions codes. The violations include, but were not limited to; acting or advertising as a real estate broker by performing services for borrowers in connection with loans secured by real property; and claiming, collecting or receiving advance fees for performing the services.

According to the Order, First One, Vescera, and El-Farra were not licensed to perform real estate services. The desist and refrain Order prohibits First One, Vescera, and El-Farra from performing any acts or practices within the State California for which a real estate broker license is required.

Comments and Analysis

Effective October 2009 in California it is illegal to collect any fees regardless of the form for negotiating or attempting to negotiate a loan modification for a residential mortgage. All modification services must be fully completed before any money can be collected. It is also illegal to divide fees or services into components for the purpose of avoiding this law.~~HUD approved housing counseling agencies are exempt from this law.
