BCA's Summary and Analysis:

Customers allege the company uses high pressure sales tactics, and misrepresent the quality and value of their products. Customers complain they purchase what are represented as high quality speakers at discount prices from company representatives in parking lots. After making the purchase, complainants reportedly discover the quality of the product is extremely poor, prompting refund requests by the buyers.

The company responds to complaints by agreeing to issue a refund, if in fact the customer can produce a receipt. Some complainants contend they were never provided receipts at the time of purchase; therefore, they are unable to provide one to obtain a refund. Allegations of inferior quality products and selling tactics are generally not addressed.

Comments and Analysis

This company sells stereo and audio equipment out of the back of trucks, vans or other vehicles in parking lots, at swap meets, or other temporary locations. Before making a purchase, we encourage consumers to do comparison shopping. . A “sale” price is not always the “best” price.

Our experience with other companies who use similar sales methods has been that solicitors use high pressure tactics to persuade impulse buyers to make purchases by offering unrealistic discounts along with promises of an easy return policy. After purchase, buyer’s remorse soon sets in as the buyer realizes they got what they paid for, and they are unable to locate the company to return the item. Typically, the solicitors fail to provide receipts, or the purchase invoice does not display accurate contact information. Items are sold without warranty information, or may be defective or discontinued models.

Virtually any consumer transaction in the amount of $25 or more which takes place in the buyer's home or away from "appropriate trade premises" can be canceled by the buyer, without penalty or obligation, within three business days after the buyer signs the contract. The Cooling-Off Rule requires a seller of goods or services costing $25 or more, at a place other than the seller's regular place of business, to inform buyers of their right to cancel the sale within three business days and receive a full refund. This rule applies to sales made "at a place other than the place of business of the seller," such as in consumers’ homes or at hotels or other temporary business locations. In addition, the seller must furnish the buyer with a summary of the buyer's cancellation rights, and two copies of an actual cancellation form.
