BCA's Summary and Analysis:

Complainants allege misleading selling practices, and unauthorized debits from accounts. Customers complain they applied for a pay-day loan on the internet, and as a result, were automatically enrolled in an ID theft protection plan without their authorization. Applicants complain the company deducts $31.98 from their checking accounts monthly for the service. According to complainants, the company refuses to issue refunds, and advises them if they had read the terms and conditions of the payday loan agreement they would have been aware of the monthly charges. In other cases, customers complain they merely clicked on the website, and clicked out, but the company still deducted the monthly charge from their account.

The company responds to some complaints by agreeing to cancel services, and issue refunds or credits to accounts. In other cases, the company offers apologies, and states they have insufficient information to research the complaint, and request that customers provide additional information such as bank account numbers to facilitate a resolution. Some complainants dispute that they actually have received promised refunds or credits. Some complaint responses did not address the complainants allegations, and were returned to the company for reconsideration.

Often, you can unknowingly join a plan simply by accepting an introductory offer of merchandise or services. Continuity plans may offer an introductory "free trial period" to let you check out the service and decide whether to join the plan. If you fail to cancel the service within the free trial period, not only must you pay, you automatically become a plan member. Joining a continuity plan means you agree to the plan's sales method as long as you're a member. You'll automatically receive services without any announcements or rejection forms before each service period. The services continue until you cancel your membership.

Sellers must give you information about the plan's terms and conditions, clearly and conspicuously, in their promotional materials. These terms may include; that you become a member if you accept the introductory merchandise or initial round of services, unless you cancel; or that periodic delivery of merchandise or services will occur - with no further action on your part; and will continue until cancellation is received. It also must disclose a description of the merchandise or services you agree to buy, say whether there's a minimum purchase, and how often you'll receive the products or services. An explanation of the plan's billing procedure for each shipment or period of service must also be provided, as well as the terms of the plan's refund or return policy; how and when you can cancel your membership; and the price of the goods or services if you fail to cancel, including shipping and handling, if applicable.

Other Considerations

The BBB reminds consumers never to provide credit card numbers or other credit card account information, or provide any private financial or personal information (such as your checking account number or social security number) to anyone who contacts you by phone. Your credit card company or other financial institution will never ask you to provide your account number over the telephone if they are initiating a call to you regarding your account.

If the caller claims to be from your bank, credit card company, government agency or other organization, ask that they put their request in writing and send it to you. And, ask for a name, physical location and telephone number. Then call the BBB to report your experience.

If you have divulged personal financial information to unknown callers, contact your Credit Card Company or bank immediately.
