To be recommended to everyone in foreclosure.

Five stars is not enough for this nonprofit organizations assistance. I found in this Nonprofit Alliance a sharp intellect combined with a desire to help unconditionally in my Sr Advocate Juan Chavez . He has assisted me with my property and ensured that it is protected. I also received help from a loss mitigation expert Jessica working closely with one of the nonprofits affiliates The CDLG.I also received important information from Carlos cotta an experienced real estate agent referred by NACALAW to guide me on another property I am trying to sell. I highly recommend them to anyone seeking to protect their home. I submitted a loan modification at first but my lender refused to modify and abide by my basic rights so we decided to litigate . Do not hesitate to work with this Bona fide nonprofit . Though I am still in the stage of litigation I am confident that the results will be positive.

Comments and Analysis

Effective October, 2009 in California, it is illegal to collect any fees, regardless of the form, for negotiating or attempting to negotiate a loan modification for a residential mortgage. All modification services must be fully completed before any money can be collected. It is also illegal to divide fees or services into components for the purpose of avoiding this law.

HUD approved housing counseling agencies are exempt from this law. For businesses outside of California, please check with the agency that regulates this industry.

In regards to credit repair offers, our experience with similar offers is that they advertise various credit services which they claim are designed to provide assistance to consumers with poor credit histories to improve their rating by removing negative items or creating a new credit file.However, clients of these types of offers generally complain that their credit histories do not improve, that they are unable to contact the company making the offer, and ultimately that refunds for failing to provide the promised services are not provided.

By law, information stays on your credit report for seven to 10 years. Accurate negative information can only be removed by with cooperation of your creditors, and this usually involves paying all or some of the debt. If you believe your credit report contains erroneous information, you may dispute the entry by calling or writing the the credit reporting agency. While in dispute, the negative item may be removed temporarily from your report, however it will be added on again if determined to be valid.

According to California Law, it is unlawful for any entity offering to improve or repair your credit to charge fees in advance of performing those services, even if properly registred and bonded with the California Attorney General's Office.

Other Considerations

On December 9, 2021 and October 15, 2021, Business Consumer Alliance (BCA) wrote to Nonprofit Alliance of Consumer Advocates (NACA) requesting information and documentation regarding their services. Some of the requested information includes:
• NACA's State Bar license to provide legal services
• Copy of NACA's C.H.A.M.P. package
• List of 3rd party affiliates that provide services for NACA clients
• Copy of the contracts NACA clients are provided from the 3rd party affiliates
• Copy of the materials and information given to client regarding the consumer protective products and services not included in the no fee agreement.
• Information regarding their Charity filing with the Department of Justice
• Clarification of their contract.

To date, the company has not provided all information requested although they replied that they would.

BCA urges caution. We believes the company may be charging advance fees for services including mortgage relief and credit repair services.
