~ Mass joinder lawsuits usually involve specialized law firms or attorneys typically solicit homeowners urging them to participate in lawsuits against their mortgage lenders as a way to obtain favorable loan modifications and stop foreclosure. The solicitations generally are made to homeowners that are behind on their mortgages or who are in default or foreclosure. In general the firms lead homeowners to believe that by paying up-front fees which can range from a few thousand dollars to over $10 000 to join similar homeowners in suing their lender they can either: stop foreclosures; reduce loan balances or interest rates; get money for damages; or even get homeowner’s titles free and clear of their existing mortgage. Mass joinder lawsuits differ from class action suits in that most class action cases don’t require the member to pay legal fees in advance.

~ In many instances the firms fail to deliver on promises made to obtain relief for homeowners. Homeowners have lost their homes along with upfront fees they pay for litigation and end up in more dire circumstances than when they began. There is no timeframe for how long these cases may last and during this time lenders will more than likely take actions against the borrower if mortgage payments are not made. Many firms fail to use qualified attorneys or pursue homeowner’s cases. While many mass joiner advertisements and solicitations tout that the business has an attorney on staff in most cases that attorney if there is one more than likely is not reviewing each homeowner’s file and may not even be licensed in the homeowner’s state. Some even allow sales agents not licensed attorneys to give legal advice about the likely results of joining in the lawsuit.

~ Business Consumer Alliance urges those in need of foreclosure relief to explore the variety of options to save your home.  Some tips to help you obtain foreclosure relief include contacting and directly communicating with your lender. If you are behind on your mortgage payment(s) or know you are having trouble with paying your mortgage the lender may be able to help you with a new repayment schedule. Mortgage servicing rules require certain servicers to provide the borrower with all foreclosure relief options available to them and assistance with submitting loss mitigation applications.

~ If you choose to take legal action against the lender you should:

~ ·         Obtain information about the lawyer(s) that will represent you and check that they are currently licensed in your state and their area of expertise in real estate law. Also check to see if any disciplinary actions have been filed. Obtain a reliability report from BCA.

~ ·         Get specific information regarding the process and what exactly the attorney(s) will do for you including cost and payment schedule. Have the information put into writing.

~

~ ·         Ask to speak with the attorney directly to discuss your case and the services. Inquire into how many mortgage related cases the attorney has handled through trial or settlement and ask for proof.

~ ·         Be leery of attorneys who make promises and guarantees as to the outcome of your case.

~

~ ·         Maintain communication with your attorney throughout the case and keep good records of conversations documents and other correspondences.

~

~ ·         Ask friends relatives and other trustworthy individuals for references of attorneys who have successfully handles foreclosure and mortgage related issues.

~ ·         Never pay advanced fees for loan modification services.
