Thank you for reaching out and for speaking to our Compliance Analyst, Zipporah, about your concerns with not being able to register the vehicle associated with the above account. Please also accept our condolences for your loss – we send our sincerest regards to you and your family. Unfortunately, we are unable to release our lien as you have requested because there is still a balance remaining on the account. Further, we sent the enclosed April 24, 2025 letter and related title paperwork to the Clayton County Tag Office to authorize the title to be changed to your name and for Credit Acceptance's lien to remain on the new title. Our records show that our letter and the title paperwork were delivered in April 29, 2025. We recommend that you contact the Clayton County Tag Office to confirm if they received our letter with the title paperwork. If the letter and title paperwork were lost, please work with the Clayton County Tag Office to obtain a duplicate title. If, however, the Clayton County Tag Office received our letter and title paperwork and still require a lien release, then you have the option to surrender the vehicle to Credit Acceptance. If you need any further assistance, please contact our Titles Department at (877) 271-0509. If you have any follow-up questions, please do not hesitate to contact Zipporah at (855) 862-5100.

RESPONSE: Refuse to adjust, relying on terms of agreement Amount in Dispute: $1,200.00 Amount Settled: $0.00

Customer Complaint

I had a vehicle financed with this company. The vehicle was involved in an accident and totaled out. My insurance company and Gap company paid the remaining balance for the vehicle. Credit acceptance told me I still had a balance of 1200 dollars. They never explained why they just put late payments on my credit report. They are reporting inaccurate information on my report and telling me it's my insurance company's fault. They can change the status of the account reporting on my credit report. This is hindering me from doing a lot and hurting my credit. Resolution Sought I would like them to update the status of the account to never late. It's being reported unlawfully.

Thank you for your continued feedback and taking time to speak with Our Compliance Analyst, Caprice, While we are always willing to assist you with new or different questions about your account, our October 30, 2024 response to your previous CFPB complaint addressed the total loss, credit reporting issues and alleged statue violations you mention in your most recent CFPB complaint. A copy of our previous response is attached for your reference. As to your current complaint, it appears your believe an IRS Form 1099-C should not have been provided as you contend the account was paid off by insurance and GAP proceeds. As stated in our prior response, these proceeds were applied to the account but did not satisfy the full balance, so your account was not immediately closed. Instead, you later settled the account for less than the remaining balance and we waived the rest. Because the amount of debt that we waived was greater than $600, we were required to send you an IRS Form 1099-C which we already have. If you have additional questions about Form 1099-C, please reach out to your tax preparer, accountant, or the IRS directly. I also reviewed the allegations in your complaint relating to the federal regulations and statue you referenced. My investigation showed once again that Credit Acceptance has fully complied with al applicable laws. The statues you reference in your complaint are either inapplicable to your situation or have been complied with fully. For instance, much of the provisions of the Fair Credit Reporting Act that you cite discuss credit reporting agencies' furnishing of consumer reports, and the proper uses of consumer reports. Credit Acceptance is not a credit reporting agency. The term 'credit reporting agency' refers to the credit bureau, such as TransUnion, Experian and Equifax. In sum, I can again confirm we have serviced your account properly and furnished accurate information to the credit reporting agencies. I sincerely hope this letter has answered all your concerns and questions. If you have any additional questions regarding our response, please do not hesitate to contact Caprice directly at 855-862-5100.

Company Final Response

I have taken a deeper look into the consumer's payment history and hope these additional details provides clarity. Per the contract terms, Mr. Hayes agreed to make 66 consecutive payments of $619.49 on the 1st of each month, starting September 2022. A total loss of his vehicle was reported, but while the claim that Mr. Hayes filed against his insurance policy was pending, he remained responsible for continued payments as outlined on Page 3 of the contract under the "Ownership and Risk of Loss" section which states he would pay all that is owed under this contract even if the vehicle is damaged, destroyed or missing. As stated in the enclosed GAP benefits letter, an insurance adjustment – due to the vehicle's condition at time of loss – was deducted from the insurance proceeds. As a result, the insurance proceeds and GAP benefits were not enough to cover Mr. Hayes' account balance, and the account remained open. Mr. Hayes continued to be responsible for making payments towards his account balance. We accurately reported a late status to the creditreporting agencies consistent with Mr. Hayes' Transaction History.
