I purchased a extended warranty on a car, the car has been paid in full I have a letter from the bank stating the car has been paid in full, The extended warranty was cancelled I have that paperwork, the refund amt 1855.22 was sent to the dealership, I have a copy of a check the dealership said it sent to the bank on 1-10-24 as of 2 /6/24 the dealership stated the check has not been cashed by the bank I inquired about cancellation of the check then write me another check I was told by law the check had to be returned to the bank because the warranty was financed with the car I one again said I have a letter from the bank the car has been paid in full! I was told by the business officer manager and the financial officer that the law requires them to send it back to the bank! I have been fighting this now for over a month all I want is my money, there is no Lean on the car it again was paid for in full, At this point I'm desperate please help me Resolution Sought I want my refund Amount that was sent to Florence Toyota that is my money

Mr. Taylor contacted Florence Toyota concerning the cancellation of products within a contract for his son. Upon research the cancellation was completed and the check for refund was sent to the lien holding bank, BMO Harris. It is the requirement within the Dealer Contract with all lien holders that the funds for cancellation be provided to the lien holder unless the lien holder specifically states otherwise in writing. This is because the amount for cancellation is most usually deducted from the amount of the payoff with the knowledge that the product cancellations will provide the difference. Without written confirmation that BMO has no interest in the funds, Florence Toyota is unable to issue funds directly to the consumer, This was explained in depth to Mr. Taylor Sr, and the opportunity to provide that information stands until BMO processes the cancellation funds.

Florence is aware that the car has been paid off for over a month in my statement on or around February 6, 2024 the dealership states that the check that was supposedly sent to BMO Bank has not been cashed, again they are unwilling to provide me confirmation that the check has been sent again all I’m getting the runaround from Florence Toyota per BMO bank, finance company they do not have any check sent to them from Florence Toyota and if they did get a check from Florence Toyota, the refund would come back to me. I don’t understand what the issue are. The problem is other than this crooked dealership is trying to cheat me out of my money all I’m asking for is a refund on the amount of money that Florence Toyota owes me stop giving me the runaround on how you send money back to the finance company, if they feel like the car is not paid in full I have a letter that I have shown them. I’ve asked them to call them. This has fallen on ears every time I’ve went there , I don’t understand why it’s so hard to refund somebody’s money to them how does a bank that has been paid in full and I have a letter stating that the car has been paid in full . Florence Toyota will stop payment and reissue the check to BMO Harris. Without written statement that these funds are due directly to the customer from BMO Harris, that is the best we can provide. This has been offered before and declined. If the payoff was not reduced by the cancellation amount, BMO will refund the amount as previously explained.

Sold a car to me that had been wrecked and did not disclose to me that it had been wrecked. Kept my rav4 for 3 1/2 weeks stating first they were repairing it then they were going to swop. Collateral on my loan and then they were gonna trade it in which they did none of the above. Ran my credit multiple times Promised another key to my rav4 and never got. Scratched the door while had my rav 4 said would setup appointment to have it fixed still has not done that. Speed odometer cluster still making noises. Gas gauge computer still not registering correctily my mileage is 23825. I've asked them to buy car back neumous times because they will not fix the issues and the fact they did disclose that it had been wrecked when we asked. But they refuse. Resolution Sought I want the dealership to buy the car back.
