BCA's Summary and Analysis:

Most complainants allege misrepresentation of the job offer false advertising concerning the availability of management positions and inability to obtain refunds. Some customers complain the company fails to disclose the terms and conditions of employment before collecting advance fees. Complainants allege after paying the required non-refundable fees they learn they are independent contractors not company employees and the job offer is actually a sales position requiring applicants to sell a minimum of $3000 worth of equipment prior to becoming a manager. A few people complain the company does not provide written verification of earning claims made. One trainee who claims to have met the sales quota alleges the company failed to disclose that managers are responsible for the costs associated with opening their own offices. Most complainants request refunds after finding out the manager positions offered are actually for sales. ~~The company responds to most complaints by disputing the complainant’s allegations and denying most refund requests. The company also contends that all applicants must sign agreements prior to employment which clearly state the terms and conditions of employment. The company addresses allegations concerning verbal misrepresentations by reminding complainants that per terms of the agreement the written contract over rides any verbal representations.

Comments and Analysis

The company advertises management trainee positions touting high earnings claims in local newspapers and on various internet job sites. Respondents are initially required to pay a non-refundable registration or background check fee of $60. As a condition of employment job seekers are also asked to purchase a sales kit at a cost of $95 which the company claims is refundable upon becoming a manager. Management trainees and sales representatives are not hired as employees of the company but rather are hired as independent contractors. After purchasing the sales kit employment hopefuls learn that they must sell $3000 worth of product before they are eligible for a management position. ~~When looking for a job keep in mind companies who are really hiring employees do not usually charge their employees for the privilege of working for them. Be suspicious of employment offers that require advance fees or advertise unrealistic earnings claims. You should not have to pay a fee to learn the details of a job secure job-placement assistance obtain a “background” or “identity” screening or accept an employment offer. Job seekers who respond to these ads think they are contacting a bona fide employment offer to fill a specific job. Instead they reach a business that creates the impression that after paying fees for training or buying necessary equipment that high paying jobs are available. In some cases job seekers may be led to believe that most or all of the fees ultimately will be conditionally refunded however our experience with these offers has been that refund eligibility conditions imposed make refunds nearly impossible.
