Complainants allege a variety of warranty and repair problems, delays with parts exchanges, and obtaining refunds. Some customers complain that merchandise arrives damaged by shipping. Other customers complain that defective parts sent back to the company for exchange are replaced with defective parts and their vehicles remain inoperable. Some complainants allege after several months, problems are not resolved and they have not been able to use their vehicles.

The company responds to all complaints by agreeing to send replacement parts, exchange merchandise, or provide refunds if requests are received within 7 days of delivery as stated in their refund policy. The company reminds complainants that they are unable to accept returns on vehicles that have been assembled, fueled or used as the vehicle would then be deemed a "used vehicle." Most States require that the manufacturer or seller of a product offer an implied warranty—some sort of guarantee that the product will work once it is out of the box and that it will work in the way that its manufacturer says it will. A wet vacuum that is supposed to suck up water from the garage floor has to perform that job, or the consumer has a legal right to return it for one that does. The length of time that these implied warranties are in effect varies from state to state.

Limited warranties, which must be labeled so in writing, limit the liability of the manufacturer. A limited warranty may offer to replace defective parts free while still levying high labor charges or require that the consumer ship the product to a manufacturer-approved service center. The distinctions between full and limited warranties and the obligations of manufacturers to honor them vary from state to state so it is up to the consumer to carefully read the literature and understand what is covered before the purchase. Fortunately for consumers, manufacturers are required to follow any implied warranties created by local laws.

Other Considerations

The Federal Trade Commission's Mail Order Rule allows the seller 30 days to ship ordered products to the buyer unless otherwise specified at the time of purchase. If the seller cannot ship within the 30 day period, they are required to notify the buyer in writing of the delay, and give the option of waiting, or having their money returned within seven days. Credit card payments must be credited within one billing cycle.
