BCA's Summary and Analysis:

Many complainants allege deceptive and misleading advertising, inadequate disclosures of their terms and conditions, unauthorized credit charges and difficulty cancelling. Most complainants allege the company charges their credit cards for $100.00 instead of $1.99 trial price. Other complainants allege they cancel their membership or trial offering within 7 days as required; however, accounts are not cancelled causing additional fees to be charged to their credit cards. Some complainants allege the membership package holds no value and is not worth the $100.00, and contains only information on how to create a Twitter account. A few customer complaints allege the company fails to deliver the package at all.

The company responds to some complaints by stating the customer failed to read terms and conditions during sign up; however, in most cases provided refunds or partial refunds regardless.

Comments and Analysis

This company claims to offer information on how to earn money using the Twitter social networking site buy promoting affiliate advertisements to earn commissions. The offer is presented in the form of an E-book advertised as a 7 day trial program for $1.99 with a negative option cancellation clause. If no cancellation is received within the 7 day trial, the respondent is automatically charged $99.99 a month. In addition those who agree to the 7 day E-book trial report they are also automatically enrolled in another 15 day trial offer for the SearchEngineProCourse.com. This product is offered with a 15 day trial negative option, and billed at $9.99 per month if no cancellation is received within the specified time period.

On-line users need to be careful when browsing the Internet and responding to unsolicited offers. If an ad seems too good to be true, it probably is. Talented individuals can use a Web Page to create a company that looks very legitimate, but just because an ad looks legitimate on the computer screen, is no reason to assume it is. Many questionable work-at-home offers are perpetrated through classified advertising. No matter where you find classified ads online, you are likely to find some false and misleading claims. For example, some classified ads promote quick and easy get rich ventures, traditional pyramid schemes, or the basic chain letter scenario. Traditional work-at-home schemes, such as making handicrafts or stuffing envelopes, have been replaced by offers to use your home PC to make money fast in your spare time. Con artists who previously touted scams through newspapers, U.S. mail and telemarketing are using computers to reach potential victims. They can sit at their keyboard and reach hundreds of thousands of people, pretty much for free, in a short period of time. Getting a phony ad or message out is now cheap and easy. To evaluate tempting, on-line solicitations which offer a chance to earn money by working at home, follow the same signals that tip you off to potential frauds in print and other media. Watch out for warning signs to questionable online advertising, such as overstated claims of product effectiveness, use of hype titles, exaggerated claims of potential earnings, profits, or part-time earnings, or claims of “inside” information.

Other Considerations

We urge caution before agreeing to trial offers or giving your credit card number to unfamiliar companies with unfamiliar products. Although this company's offer is advertised as free, the charge imposed for shipping and handling of the product, ($6.95) actually makes the offer NOT free. Once your credit card number has been provided to cover shipping and handling, it will remain on file with the seller for shipping and billing purposes. If you forget to cancel, or for any reason fail to do so, your card number is readily available to bill for your first shipment of product. Although the company's many websites make cancellation procedures appear fast and easy, in reality customers report that cancellation requests are ignored, calls are not returned, credit cards continue to be charged, and unwanted product shipments continue to arrive.
This company's free trial is conditional upon accepting their offer for additional product. FTC Guidelines for advertising this type of offer require that all terms and conditions of the offer, as well as cancellation instructions, be clearly and conspicuously displayed in at least 10 point type before asking for payment or obtaining the customer's consent. Clearly and conspicuously means, NOT disclosed in microscopic print accessed by a web link to another site, but rather, disclosed along with the free trial solicitation. Regardless, many consumers overlook the advisory, and are unaware of the charge until their next monthly credit card statement. In this company's case, consumers complain they are unable to cancel services by using the instruction provided by the company. Even worse, they are unable to contact the company at all. Emails are not returned or acknowledged, and calls are not returned. Industry guidelines require marketers to provide a fast easy method of canceling, either by mail, phone, or website, Failure to do so may be a violation of consumer protection laws.
Most credit card issuers will allow the cardholder 60 days to dispute an unauthorized or inaccurate charge. Review your monthly statement carefully. If you discover a charge which is unfamiliar, investigate and dispute the amount with your card issuer as soon as possible to protect yourself from making unwanted purchases.
