Licensing

California law requires any company that procures or offers to procure employment or auditions, or that provides artist management services, direction or counseling to develop an artist's career, for any of which they collect a fee in advance, to post a $10,000 bond. Companies that charge in advance for such services as registering or listing the artist for employment, photographs, videotapes, other promotional materials, costumes, lessons or training, or auditions are also considered advance fee talent services and are subject to this bonding requirement.

To obtain bonding information, write to the Division of Labor Standards Enforcement, Department of Industrial Relations, Legal Section, at P.O. Box 420603, San Francisco, CA 94142 or call (415) 703-4846 or by email to DLSE.licensing@dir.ca.gov. The website address is www.dir.ca.gov.

Comments and Analysis

This company advertises for models for catalog and print work. Respondents report they are propositioned to enter into a contract with the company to model clothing. Models are required to pay a refundable advance fee of about $300 in exchange for 12 fashions, with an estimated retail value of $300. According to the contract, the company promises to send a professional photographer to the models home town to schedule a professional fashion catalog shoot at a future date. The contract further states the photographer will supply the model with the (12) best digital shots, one of each fashion. It is the model’s responsibility to send one image per month by e-mail to Worldwide for publishing and sales purposes. Refund eligibility on the advance fee is based on the model sending one photo a month over a 12 month period. The company claims the advance fee is necessary to safeguard the company from models who would simply keep the clothing without sending in the photos.

We believe this company is an advance fee talent service, therefore, subject to licensing by the State of California. Would be models report once the company receives the advance $300 fee, they are unable to make contact or collect a refund. Those who have received clothing after sending the initial fees reportedly received less clothing than agreed, or nothing at all. Some report there is no photographer, and models are required to take their own pictures. Regardless, if 12 different photos are not sent in a 12 month period, the model would be ineligible for a refund. We believe the company earns their profits from collecting the $300 advance fee. When the company fails to fulfill contracts, models will also fail their contractual obligation in sending 12 photos, thus, no one is eligible for a refund.
